Agreement to Terms

By accessing or using the XolNexo website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access our website or use our services.

Description of Services

XolNexo provides independent technical inspection services for new apartment buyers in Chile. Our services include:

  • Pre-acceptance inspections of new residential properties
  • Detailed inspection reports with photographic documentation
  • Identification of construction defects and finishing issues
  • Professional assessment of property condition

Our inspections are visual assessments of accessible areas and systems. We do not perform destructive testing or examine areas that are not readily accessible.

Service Limitations

Scope of Inspection

Our inspections cover visible and accessible finishing work, installations, and systems within the property. We do not:

  • Perform structural engineering assessments
  • Conduct invasive or destructive testing
  • Inspect areas that are not accessible or visible
  • Provide cost estimates for repairs
  • Guarantee that all defects will be identified
  • Make predictions about future property condition

Professional Opinion

Inspection reports represent the professional opinion of our inspectors based on visual examination at the time of inspection. Conditions may exist that are not visible or detectable during a standard inspection. Our reports are intended to inform buyers about observable conditions and should not be considered exhaustive inventories of all property conditions.

Client Responsibilities

As a client, you agree to:

  • Provide accurate information about the property to be inspected
  • Ensure access to all areas of the property during the scheduled inspection
  • Review the inspection report carefully and seek clarification on any unclear points
  • Use the inspection report as one factor in your property acceptance decision
  • Understand that the inspection does not guarantee the property is free from all defects

Scheduling and Cancellation

Appointments

Inspection appointments are scheduled based on mutual agreement. We will make reasonable efforts to accommodate your preferred timing. Property access must be arranged by the client.

Cancellation Policy

Cancellations or rescheduling requests should be made at least 48 hours before the scheduled inspection time. Cancellations made with less notice may be subject to cancellation fees.

Fees and Payment

Inspection fees are determined based on property size, location, and complexity. Payment terms will be communicated when scheduling your inspection. Payment is typically required before or immediately after the inspection is completed.

Inspection Reports

Delivery

Inspection reports are typically delivered within 48 hours of the inspection. Reports are provided in digital format and include photographs of identified issues.

Use of Reports

Inspection reports are prepared for the exclusive use of the client who commissioned the inspection. Reports may not be transferred, sold, or provided to third parties without our written consent, except as necessary for property acceptance negotiations with developers.

Report Accuracy

We make every effort to ensure report accuracy. However, if you identify any errors or omissions in the report, please notify us within seven days of receiving the report so we can review and address the concern.

Limitation of Liability

To the maximum extent permitted by Chilean law:

  • Our liability for any claims arising from our services is limited to the fee paid for the inspection
  • We are not liable for consequential, indirect, or incidental damages
  • We are not liable for defects that were not visible or detectable during the inspection
  • We are not liable for conditions that develop after the inspection date

This limitation of liability does not affect any rights you may have under Chilean consumer protection law that cannot be waived by contract.

Indemnification

You agree to indemnify and hold XolNexo harmless from any claims, damages, or expenses arising from your misuse of our inspection reports or violation of these Terms of Service.

Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of XolNexo and protected by Chilean and international copyright laws. Inspection reports prepared for you remain our intellectual property but are licensed to you for the specific purpose of property acceptance evaluation.

Website Use

Acceptable Use

You may use our website only for lawful purposes. You may not:

  • Use the website in any way that violates Chilean law
  • Attempt to gain unauthorized access to our systems
  • Transmit malicious code or viruses
  • Interfere with other users' access to the website
  • Collect information about other users without consent

Website Availability

We strive to maintain website availability but do not guarantee uninterrupted access. We may suspend or modify website features without notice for maintenance or improvements.

Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.

Dispute Resolution

Any disputes arising from these Terms of Service or our services will be governed by Chilean law. Both parties agree to first attempt to resolve disputes through good faith negotiation. If negotiation fails, disputes will be resolved through the courts of Calama, Chile.

Professional Standards

Our inspectors follow professional standards for property inspection in Chile. We maintain professional liability insurance and comply with applicable regulations governing inspection services.

Third-Party Services

Our website may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party services is at your own risk.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid under Chilean law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and XolNexo regarding use of our website and services.

Consumer Rights

Nothing in these Terms of Service affects your statutory rights as a consumer under Chilean law (Law 19.496 on Consumer Rights and Duties). If there is a conflict between these terms and your statutory rights, your statutory rights will prevail.
